Torchy’s Tacos lawsuit has put the Texas restaurant chain under scrutiny after a customer allegedly discovered a cow tooth in her meal. The woman claims she nearly swallowed the object and later sought medical treatment. The company has confirmed the tooth’s origin, as reported by customreceipt.com.
The incident occurred on June 9, 2026, at the chain’s South Congress Avenue restaurant in Austin. Nohemi Castillo ordered a Democrat taco, containing beef barbacoa, avocado, cotija cheese, cilantro and onions.
According to FOX 7 Austin, Castillo discovered the object while eating her takeout order. Court documents state that she felt sickened and visited a doctor that evening.
Why Is Torchy’s Tacos Facing a $250,000 Lawsuit?
Castillo filed her lawsuit on October 13 in Travis County District Court. Her attorney, Scott Vasquez, argues that proper food inspections should have prevented the incident.
The complaint includes several allegations:
- Negligence in food preparation and inspection.
- Breach of implied warranties under Texas law.
- Alleged violations of consumer protection regulations.
- Failure to prevent foreign objects from entering prepared food.
The plaintiff is seeking up to $250,000 in damages, with the final amount subject to a jury’s determination.
These allegations remain legally unproven. The lawsuit does not establish that Torchy’s violated food safety laws.
Torchy’s Tacos Confirms Cow Tooth Came From Beef Cheek
The restaurant chain acknowledged the discovery in a statement reported by KVUE through CNN Newsource.
Torchy’s explained that its barbacoa comes from natural beef cheek supplied by an outside producer. The company confirmed that the object was a cow tooth.
It described such occurrences as rare and said it had reinforced preventive procedures with its supplier.
Vasquez also raised concerns about the potential choking hazard. He argued that food safety controls should have detected the object before the taco reached his client.

What Happens Next in the Torchy’s Tacos Case?
The cow tooth lawsuit now raises questions about quality control throughout the restaurant’s meat supply chain.
Although Torchy’s has acknowledged the foreign object, liability and compensation remain unresolved. A jury may ultimately determine whether the customer is entitled to damages.
